Terms and Conditions
Section 1: Dog Walking / Pet ‘Drop In’ Service

All dog(s) will have a current Hong Kong Dog License (proof will be required). Client represents and warrants that dog(s) are currently licensed and vaccinated against Rabies, in accordance with all local Hong Kong regulations under the relevant local Hong Kong ordinances (Cap 421a and Cap 167).

ACAS / Karina O’Carroll agrees to provide dog walking, pet sitting and other applicable pet care services in a reliable, caring and trustworthy manner. In consideration of the services and as an express condition thereof, the client expressly waives and releases ACAS / Karina O’Carroll from any and all claims against the sole proprietorship, its owners, employees and representatives, except those arising from negligence or wilful misconduct on the part of ACAS / Karina O’Carroll.

ACAS / Karina O’Carroll shall exercise all precautions against sickness, injury, escape, loss, accidents or death of Client’s pets(s). The pet accepted for dog walking / drop in service, shall be walked / looked after by ACAS / Karina O’Carroll at the sole responsibility of the legal owner of the pet, and ACAS / Karina O’Carroll shall not under any circumstances whatsoever be liable in the event that the pet depreciates in value, sustains injury, dies, becomes ill, goes missing or escapes. However, in case of any claim for compensation of proved negligence, ACAS will take maximum liability of HKD$2,000 related to each pet under ACAS / Karina O’Carroll’s care.

Client agrees to notify ACAS / Karina O’Carroll of any concerns within 24 hours of completion of services.

Client agrees to pay all charges accrued for services rendered. Client understands that payment is due 7 days after the issuance of invoice from ACAS. Invoices will be issues on the last day of service provision or at the end of the month in the case of long-term service provision.

Client agrees to make payment via direct bank transfer or PayMe to Karina O’Carroll (ACAS) as directed in all invoices.

ACAS / Karina O’Carroll will follow the directions of the Veterinary Release document, in the case a pet should become injured or sick while they are under ACAS’s care.

Client accepts responsibility for all medical expenses and other damages resulting from an injury to Karina O’Carroll (ACAS), other persons or other animal(s) caused by the Client’s pet(s) or negligent act.

Client agrees to indemnify, hold harmless and defend ACAS / Karina O’Carroll, in the event of a claim by any person injured or otherwise damaged by Client’s pet(s) or negligent act.

Client agrees to give ACAS / Karina O’Carroll 24 hours’ notice of cancellation or reschedule. No fee will be charged, but repeated reschedule / cancellation at the last minute, may result in ACAS / Karina O’Carroll being unable to provide services for your pet(s) in the future.

ACAS / Karina O’Carroll reserves the right to terminate this contract at any time if in her sole discretion, she determines that the Client’s dog(s) poses a danger to the health or safety of herself, other pets or other people. If concerns prohibit ACAS / Karina O’Carroll from caring for the dog(s), ACAS / Karina O’Carroll will attempt to contact to contact the Client to arrange alternative care. If the Client cannot be contacted, the Client authorizes ACAS / Karina O’Carroll to place the dog(s) in a licensed kennel with all charges and fees arising to be the responsibility of the Client.

ACAS / Karina O’Carroll reserves the right to refuse service to any client, at any time, for any reason.

This document gives ACAS / Karina O’Carroll authorization to enter the Client’s listed address as needed to perform agreed upon services.

Clients will provide 2 sets of keys for access to the client’s listed property, for access to provided services to the registered dog(s). 1 key will be retained by ACAS, as a backup and kept in a secure, locked box at ACAS’s private residence. Back up key will be retained for any issues with access to the property, loss of 1 key, or any other key / access related issues. At the end of service, both keys can be returned to the client at a convenient time for both parties. If repeat services will be required, the client has the option to give permission for ACAS to retain 1 key for future service.

ACAS / Karina O’Carroll is not liable for any loss or damage in the event of a burglary or other crime that should occur at the client’s listed address, while under this annual contract.

Client agrees to properly secure the home prior to leaving the premises. ACAS / Karina O’Carroll will re-secure the home to the best of their ability at the end of each visit. If there are any issues, ACAS will notify the client immediately.

Third parties - ACAS is not liable and is completely indemnified for any and all liability stemming from the act(s) or failure to act(s) of third parties, whether known or unknown, including but not limited to, family members, friends, neighbours, pool persons, landscapers, housekeepers, utility persons, etc.

In the case of an emergency, inclement weather or a natural disaster, the Client authorizes ACAS / Karina O’Carroll to use reasonable judgment for the care and wellbeing of Client’s pet(s) and residence. ACAS / Karina O’Carroll will make reasonable efforts to maintain service during these conditions but reserves the right to adjust the schedule of service based on the sole discretion of Karina O’Carroll.

ACAS is not responsible for any damages beyond the control of the Dog Walker / Dog Sitter (Karina O’Carroll).

ACAS / Karina O’Carroll will provide photo(s) and video(s) of the pet(s) under care either within the home, on their walks and / or when they have been safely returned to the client’s home, per visit. If client has any specific requests, please notify ACAS / Karina O’Carroll.

Client is responsible for supplying the necessary equipment and supplies needed for the care of their dog(s) and pet(s) including, but not limited to, a sturdy, well-fit harness or collar and leash for walks or in case of emergencies, pet food, medications, identification tags, litter boxes, cat litter, transport crates and cleaning supplies.

Client agrees that ACAS / Karina O’Carroll may use their own humane equipment, such as but not limited to martingale collars, harnesses, slip leashes, long lines, or other necessary equipment in addition to the clients own, to ensure the dog(s) safety while under care and during service provision.

Client authorises ACAS / Karina O’Carroll to provide services (dog walks) at various locations around the Sai Kung region and permits ACAS to transport their dog(s). ACAS shall not under any circumstances whatsoever be liable in the event that the dog depreciates in value, sustains injury, dies, becomes ill, goes missing or escapes during transport or due to any vehicular incident caused by a third party. ACAS / Karina O’Carroll will take utmost care when transporting client dog(s).

Client authorizes the use of their dog(s) pictures on ACAS website, social media and/or marketing materials for promotional purposes.

Client authorizes this contract to be valid approval for services so as to permit ACAS / Karina O’Carroll to accept all future in person, telephone, online, mail or email reservations annually and provide services without additional signed contracts or written authorizations within 1 calendar year. All clients will sign new agreements annually.

The terms and conditions of this document apply to all pets owned by the client, including any and all new pets that the client obtains on or after the date this document was signed, within 1 calendar year.

In the case of illness or injury preventing ACAS / Karina O’Carroll from completing agreed upon services, every effort will be made to reschedule services. Should services not be able to be rescheduled, ACAS will refund the fees for the services unable to be provided only. ACAS / Karina O’Carroll will make every effort to notify client’s in a timely manner of any issues preventing service provision.
Section 2: Payment Terms
All balances owed to All Creatures Animal Services will be paid in full within 7 days of invoice issue, via direct bank transfer or PayMe to Karina O’Carroll.
Section 3: Cancelation / Rescheduling Policy
24 hours notice preferable, but up to 06:00am on the same day of scheduled walk. However, repeated last minute cancellations or reschedules may impact All Creatures Animal Services’ / Karina O’Carroll’s ability to provide future service.
Section 4: Veterinary Release
All Creatures Animal Services / Karina O’Carroll requires all clients to complete a Veterinary Release, outlined below. In the event of an emergency, All Creatures Animal Services / Karina O’Carroll will make every attempt, via all available means to contact the owner and the emergency contact(s). In the event that no contact can be reached by reasonable measures, All Creatures Animal Services / Karina O’Carroll will seek appropriate medical care for your pet(s). All Creatures Animal Services / Karina O’Carroll will make every attempt to take your pet(s) to the preferred veterinarian listed below, however, if your veterinarian is not available or if the situation requires getting your pet(s) to the closest available veterinarian, All Creatures Animal Services / Karina O’Carroll will bring your pet(s) to an appropriate clinic.
Section 5: House Keys
Safety is a top priority for All Creatures Animal Services / Karina O’Carroll, not only for the pet(s) under our care, but also for client’s homes and property.
All Creatures Animal Services / Karina O’Carroll will require all pet owners to provide 2 keys for access to the listed client address. 1 key will be utilised for the services agreed to and 1 key will be retained by All Creatures Animal Services /Karina O’Carroll as a backup, for the duration of the contracted services.
At present, All Creatures Animal Services will require the provision of a key to access your home for the sole purpose of collecting and returning your dog(s) in the case of dog walks, or to access your pet(s) for drop in service provision.
All Creatures Animal Services assumes no liability or responsibility for any matters relating to keys.
Should a client find themselves in need of their spare key (locked out etc) kept with All Creatures Animal Services / Karina O’Carroll, we can return the backup key ASAP for a call out fee of $100HKD.
Keys will be provided to All Creatures Animal Services before the first scheduled service, and returned to you on the day of last scheduled service.
Please provide two sets of keys. Two working copies of your house keys must be provided at time of initial Meet and Greet. All keys will kept in a locked safe with no identifiable information (other than your pets’ names) that would tie it to your home, when not in use for service provision.
Section 6: Off – Leash
All dog(s) will be walked by All Creatures Animal Services / Karina O’Carroll on leash. All Creatures Animal Services will provide various lengths of leash to allow your dog controlled free run and play, but cannot bear any responsibility or absorb the risk of allowing your dog free run off leash, unless dog(s) are in a completed enclosed environment. Even then – the risk for dog(s) mandates that on leash walking is a necessity as their care provider.
All Creatures Animals Services / Karina O’Carroll is happy to discuss this clause further with you as needed, but any exclusion from this, will be at the clients own risk.
